Terms and conditions

Terms and conditions regarding the lease of hotel rooms (hereinafter referred to as 'Guest House') and property for holiday accommodation use

1) Payment
If the booking is made on-line and effective immediately after, the credit card information must be supplied.
Providing the information of a credit card - with a sufficient maximum limit - represents the requirements for a successful booking.
SantaMargherita Lodgings has the right to proceed - as necessary - to acquire the pre-authorization or to charge an amount equal to 30% of the total amount of the reservation, in advance. The balance for the entire stay shall be paid upon check-in.
When the booking is not made on-line, upon the completion of the same reservation, an amount equal to 30% of the entire amount must be paid via wire transfer. The wire transfer of the aforesaid amount represents the requirements for a successful booking. The balance for the entire stay shall be paid one week prior to the arrival at the Guest House or apartment; if otherwise, the client booking shall be deemed cancelled and liable to the provisions of the law.
Contextually, when the keys are handed over upon arrival at the Guest House or the apartment, it shall be requested the payment in cash or by check of a fixed security deposit of Euro 100,00 for the Guest House and Euro 300,00 for an apartment. Such deposit shall be refunded to the Client upon departure, subsequent to the retrieval of keys and net of possible amounts charged for payment of damages brought to the property, furniture, or accessories set in Guest House or in the apartment, excepting the obligation of the client to compensate for potential major damages.
If the Client refuses to pay the security deposit, his refusal is as 'Cancellation of booking by the client' for all purposes the article 5 last paragraph provides. The Lessor shall have the right to withdraw from the agreement and cancel the booking, without any obligations of any type toward the Client.

2) Arrival and departure schedule
As the rental property does not have a reception area available, the arrival time at the Guest House or the apartment shall be prearranged by the Client with the secretary of SantaMargherita Lodgings at least one week prior to the commencement of the rental period, and shall be scheduled between 15.00 and 20.00. If the arrival occurs after 20.00 (and potentially not after 23.00), the Client shall be liable for payment of an additional amount of Euro 35,00. For different arrival times, the confirmation shall be communicated to the Client subject to specific agreement.
In any case, the Client shall be responsible for communicating via phone his precise location as soon as he arrives in Venice-historical center, or prior to notifying the inability to check-in as agreed.
The departure shall occur before 10am on the check-out day.

3) Bed and bathroom linen
The supply of bed and bathroom linen is included in the accommodation price. The client renting an apartment may request a midweek linen change, subject to an additional fee of Euro 25,00 for a complete change of the bed and bathroom linen.

4) Utilities and cleaning
The consumption of utilities such as electricity, gas, and water are included in the rental price along with the cost for the end-of-stay cleaning of the Guest House room or the apartment.
The Client shall not be held liable, in any way, for electricity interruptions, or, water or gas shut offs, owing directly to the fault of the Lessor.

5) Cancellation of booking by the client
If the Client, subsequent to the confirmation of the reservation, cancels the same with a prior notice of 30 to 15 days from the expected day of arrival, 15% of the total amount of the reservation (i.e. 50% of the amount charged or transferred in advance) shall be acquired by the Lessor. If the Client cancels the booking with a notice of less than 15 days from the expected day of arrival, 30% of the total amount of the reservation (i.e. the entire amount charged or transferred in advance) shall be acquired by the Lessor.
If the cancellation occurs 7 days before the arrival day, the Lessor shall have the right to acquire an additional amount to balance 90% of the total amount of the reservation.
If the cancellation occurs upon check-in or subsequent to check-in and/or in case of early check-out, the entire rental amount shall be acquired by the Lessor.

6) Cancellation of booking by Santa Margherita Lodgings
Should the Guest House room or apartment object of the booking not be available anymore, the Client shall have the right to an overnight stay in another hotel room or apartment similar or superior to the unit booked. If the client refuses such option, the same shall have the right to request the refund of the entire amount paid until then without any further claims for reimbursement/damages/compensation.

7) Number of guests per Guest House room or apartment
The Client shall not occupy the Guest House room or the apartment with a number of persons superior to the information provided in the description.
Under any circumstances, it is prohibited to sublet fully or partially the property and/or room to third-parties;
non-observance of the aforementioned provision shall result in automatic termination due to non-fulfillment by the client, and the client's removal from the unit without any rights to any type of reimbursement/damages/compensation.

8) Pets & Smoking
Pets and smoking are not allowed in the guest house or apartment.

9) General rental conditions
The client shall observe the neighboring rules. Namely, from 14.00 to 16.00 and from 23.00 to 08.00, a no noise rule applies as to avoid disturbing the neighbors (the sound volume of the radio, television, and other sounds must be low).
The Lessor shall not be held responsible for potential theft occurred in the Guest House or apartment. The Client shall neither, for any reasons, duplicate the keys assigned, nor hand the keys to persons unrelated to the rental agreement. The Lessor shall have the right to go in the Guest House room to tidy up, clean and maintain it daily and in the apartment to water the plants inside or on the terrace where applicable, as well as - with prior notice given to the Client - for urgent maintenance interventions and/or repairs, or for emergency.
In any case, the lessor shall absolve the lessee from responsibilities for direct or indirect damages deriving from activities performed by other tenants or third-parties, as damages or harassment caused by the same to other parties.

10) Personal data
The parties authorize the transmission of shared personal data in relation to the fulfillment of the obligations deriving from the rental agreement.

11) Applicable law and competent court of law
The leasing of the housing unit shall be governed by law 431/98, article 1, paragraph 2, letter c, and the provisions of the Italian civil code. The rental of the apartment or Guest House room, pursuant to the Tourism Law of Veneto (33/02. Art.25, letter A) shall be regulated by the hotel contracts as usual, where applicable, and enforceable in Italy.
The agreement is subject to the Italian law and any disputes attributable to the same shall fall entirely within the competence of the court of law of Venice.
The parties expressly declare to have read and specifically approved the following articles: payments of advance and balance as requirements for a successful booking (art.1); effects incurred due to failure to pay the security deposit (art. 1, art. 5); cancellation of booking (art. 5); compensation limits in case of substitution of lodgings (art. 6); prohibition on sub-rental and provision for express removal (art. 7); exoneration of responsibilities (art.9); binding competent court and applicable law (art. 11).
